Chapter 16 - The Family Barbecue Video

A cousin had recorded the barbecue.

Not intending evidence.

She was filming kids near cornhole.

The phone caught:

Ambrose taking Callum by upper arm.

Callum pulling away.

Ambrose opening crate.

Callum saying:

“No Grandpa.”

Then shove.

Not a violent throw.

A firm force sufficient to put a resisting child inside.

Door.

Padlock.

Callum screaming.

Then me entering frame.

Slap.

Ambrose falling.

Everything.

The video helped both cases.

His.

Mine.

No one could improve memory.

Duration:

From lock click to release:

Forty-three seconds.

That mattered.

Not minutes.

Not hours.

The prior documented lessons:

Fifteen seconds.

Thirty.

Maybe one minute.

The prosecution could not prove more.

Defense argued:

Brief.

No injury.

No dog inside.

Large crate.

Ventilated.

Not substantial physical danger.

Prosecution argued:

Unlawful confinement and emotional danger to a child, plus repeated coercive pattern and deception.

The child-endangerment statute required risk of harm beyond mere upset.

Would jury find?

Uncertain.

Unlawful restraint stronger.

Then one video detail.

When Ambrose locked door, he said:

“Your father did this too.”

Callum screamed:

“I want Daddy.”

Ambrose:

“Daddy knows.”

There.

Clear.

Rafferty had never heard that line at barbecue because he was inside.

Now he did.

He left the room.

I followed later.

Not immediately.

Give space.

He sat in our car outside lawyer’s office.

“I keep thinking if I'd come out thirty seconds earlier…”

“No.”

“What?”

“Don’t do time-machine parenting.”

He looked at me.

“You were inside getting buns.”

“I know.”

“You didn't create the cage because you were in a kitchen.”

He nodded.

Then:

“I still gave Dad permission to ‘help.’”

“Yes.”

He looked hurt by my lack of absolution.

Then grateful.

“That I own.”

“Yes.”

“And what he did is his.”

“Yes.”

That was the balance we kept returning to.
