The prosecutor’s strongest evidence:
Recording.

POA limitation.
Marcus’s admission.
Weakest:
Intent.
Marcus claimed he believed his earlier marital discussions gave him authority even if Rachel later regretted it.
The recording made that difficult.
Then one issue.
One-party recording law.
Rachel recorded a conversation she participated in.
Our state permitted that.
Admissible subject to authentication.
Good.
Then fraud statute.
The prosecutor needed more than:
Bad husband.
They argued Marcus knowingly represented himself electronically as the policy owner to obtain a financial benefit.
He admitted using Rachel’s login.
Attestation said:
I am the policy owner.
That was strong.
His defense:
He had general permission to manage financial accounts.
POA excluded beneficiary changes but he was not technically using POA—he believed Rachel had separately authorized him.
Again.
Recording.
Then plea offer:
Plead guilty to one felony count involving unauthorized insurance/identity transaction.
Unauthorized-access count dismissed.
Recommend:
Short custodial term or intensive community sanction depending presentence report.
Restitution?
Insurer had not lost policy principal.
Could be investigative costs? Usually not necessarily.
No $750k restitution because money never paid.
Civil case already resolved.
No-contact conditions consistent with family court.
Marcus hesitated.
Trial risk:
Conviction on both counts.
Plea risk:
Felony.
Employment.
Reputation.
Then he asked Leo’s therapist whether pleading guilty would hurt Leo.
Therapist refused to advise legal strategy.
Correct.
He asked me?
No.
Good.
He accepted the plea.
In court he admitted:
“I used Rachel’s credentials to change the beneficiary designation to myself without her authorization.”
Judge:
“Did you understand that representation was false?”
“Yes.”
“Did you intend to receive the policy proceeds?”
“Yes.”
“Did you believe you would still use much of the money for Leo?”
“Yes.”
“Does that make the transaction authorized?”
“No.”
There.
No excuses.
