Chapter 10 - Victor had commissioned a second report
The environmental records were messy.
That helped.
Conspiracies prefer clean stories.
Real concealment creates versions.
Lake & Brower had performed the first test for Genevieve.
Victor withdrew access.
Then he hired a different firm through Mercer Property Services.
That second company performed limited sampling.
Its report noted:
“Potential vapor intrusion condition requiring additional evaluation.”
But the version stored in the Family Office environmental folder had a one-page summary:
“No immediate evidence of acute residential hazard.”
Both sentences could exist together.
One did not negate the other.
Victor relied on the second.
Genevieve never saw the full report.
Neither did I.
Why?
The report went to Mercer Family Office legal.
An in-house lawyer prepared the summary.
Victor sent me the summary during Genevieve’s illness.
I found the email.
Subject:
Genevieve environmental concern resolved
Victor wrote:
Independent follow-up found no acute residential hazard. No need to uproot the children while Genevieve is medically fragile.
I replied:
Thank you. Please make sure she receives this.
He answered:
I’ll handle it.
Four words.
I read them fifty times.
Did Victor intentionally hide a known lethal condition?
Not proven.
Did he possess a report recommending more evaluation while telling me the concern was resolved?
Yes.
Why?
He said:
“To prevent panic while we verified.”
Verification never happened.
Or not fully.
Another email showed the in-house lawyer urging:
Recommend intrusive sampling before concluding. Potential historical environmental liability may extend beyond residence.
Victor replied:
No intrusive work at Mercer House without board review. We are in the middle of Falcon closing.
Falcon.
A $420 million sale of former Mercer industrial properties to a national developer.
Environmental findings at the family residence could raise questions about how historical waste had been handled at related sites.
Victor saw a corporate problem.
Genevieve saw a health problem.
One had lawyers.
