Chapter 8 - THE PHONE BENEATH THE FLOORBOARD
Police found David’s second phone beneath a loose floorboard in his home office.
The device held hundreds of recordings.
Most began without Anna’s knowledge.
David recorded her crying after medical appointments, struggling to breathe on the stairs, and asking for help with household expenses.
He labeled the files with words such as unstable, irrational, and dependent.
The raw recordings told a different story.
Before Anna cried, Sylvia insulted her mother.
Before she raised her voice, David blocked the bedroom door.
Before she asked for money, David canceled her bank card.
Before she said she felt trapped, he reminded her that no one would believe an orphan over a lawyer.
David planned to remove the causes and preserve only the reactions.
Martin’s messages explained how.
“Cut the first thirty seconds.”
“Keep the shaking.”
“Remove Sylvia’s voice.”
“Use medical language in the filename.”
The edited clips were attached to the incapacity petition.
One recording was especially damaging.
Anna sat at the kitchen table two weeks before Christmas.
“I need my medication back.”
Sylvia answered:
“You become disobedient when your pressure is controlled.”
David laughed.
“Leave her tired. She signs faster.”
He knew exactly what had happened to the pills.
Another recording captured David and Martin after Anna went upstairs.
“If she loses the baby before birth, does the trust reset?” David asked.
Martin replied:
“The early-control clause disappears, but the age provision remains. You wait until she is thirty-five.”
“That’s years.”
“Then incapacity is still the better route.”
David said nothing for several seconds.
Then:
“Make sure the medical case survives either outcome.”
He had considered the death of his child as a timing problem.
Anna listened to the recording once.
She refused to hear it again.
Eli remained in the NICU beneath warming lights. His breathing improved slowly, but doctors warned that premature infants could deteriorate without warning.
Anna spent hours beside the incubator after recovering enough to leave her own bed.
She placed one finger through the access port.
Eli’s tiny hand closed around it.
Thomas stood behind her.
“I’m sorry,” he said.
“For what David did?”
“For allowing our silence to become a space he could fill with lies.”
Anna looked at him.
“You sent letters.”
“I could have come.”
“I told you not to.”
“You were nineteen.”
“You were grieving too.”
Thomas shook his head.
“That explains me. It does not erase what you needed.”
Anna had spent years imagining reconciliation as a dramatic moment in which one person became entirely right and the other entirely wrong.
The truth felt quieter.
Thomas had failed her without intending harm.
David had recognized the wound and used it deliberately.
“Don’t promise to fix everything,” she said.
“I won’t.”
“Ask what I need.”
“What do you need?”
“Help me protect Eli. Help me find Martin. And when I make a decision you dislike, remember that it is still mine.”
Thomas nodded.
Grace entered carrying the result of the phone analysis.
Martin had sent one final message to David during the Christmas dinner.
The father must not hear her version before the filing.
David replied:
He thinks she hates him.
Martin wrote:
Keep it that way until the baby is transferred.
Thomas read the exchange.
Martin had understood that reconciliation between Anna and her father would destroy the isolation supporting the legal plan.
The investigators traced Martin’s second phone to the private neonatal facility.
A security camera showed him entering the building the morning after Christmas.
He carried a sealed medical folder.
When he left, the facility’s administrator signed an affidavit stating Anna had voluntarily requested separation from Eli.
The administrator now admitted Martin introduced himself as Thomas Bennett’s attorney.
