Chapter 13 - Daniel’s diversion hearing
Daniel’s assault case did not disappear because Margaret behaved badly.
He completed:
Conflict course.
No-contact compliance.
Anger-management evaluation.
No further violence.
At review, prosecutor asked:
“Do you still believe hitting your mother was justified?”
Daniel answered:
“No.”
“Do you regret removing her from the house?”
“No.”
Good.
“Difference?”
“One was violence. One was a boundary.”
Exactly.
Margaret submitted statement:
“My son humiliated me and turned my grandson against me before the child could even know me.”
The court did not resolve family feelings.
Daniel’s deferred case continued toward dismissal if he completed remaining period.
No conviction yet.
Then Margaret’s lawyer tried using Daniel’s assault in grandparent court.
Argument:
Daniel’s decision-making was distorted by guilt and anger.
The judge allowed limited relevance.
Then one surprising witness.
Rebecca.
Daniel’s sister.
Margaret’s daughter.
She testified reluctantly.
“My mother loves intensely.”
Not helpful.
Then:
“She also treats access as proof of love.”
Better.
“Did she cancel Clara’s postpartum care?”
“She told me she did.”
“Did she say why?”
“She said Clara needed to learn.”
“Learn what?”
Rebecca looked at Margaret.
“That our family doesn’t hire people to do what women should do.”
There.
Class and gender.
Then:
“Did your family hire postpartum help when your children were born?”
Rebecca almost laughed.
“Yes.”
“How much?”
“My mother paid for a night nurse for six weeks.”
The courtroom changed.
Margaret stared.
Hypocrisy documented.
Why different?
Rebecca:
“Mom liked my husband.”
There.
I was the low-class outsider.
Then defense cross:
“Does your mother love your children?”
“Yes.”
“Has she ever harmed them?”
“No.”
“Was she helpful after your births?”
“Extremely.”
This mattered.
Margaret was capable of excellent care when she respected the mother.
The issue was not ignorance.
It was contempt toward me.
Then Rebecca testified:
“Mom told me Clara needed to be humbled before the baby arrived.”
When?
Three weeks before delivery.
Exact words?
Text existed:
Clara thinks motherhood is another app she can optimize. The baby will humble her.
Not:
I will humble her.
Still.
Then another:
If she becomes liaison, she’ll turn Dad’s trust into a reimbursement machine for outsiders.
There.
The trust motive remained.
Then full grandparent hearing was scheduled for eight weeks later.
