Chapter 9 - The deleted draft

The phone held one unsent message.
Not recovered through magical hacking.
It existed in the messaging app’s draft state when forensic technician made the image.
Recipient:
Me.
Text:
Dad shoved me and I hit the counter he says if I tell you it will destroy the family
No send timestamp because it was never sent.
Last modified:
Monday 7:07 p.m.
Two minutes after the smart speaker attempted to call me.
That was powerful.
Could Michael have typed it?
Defense asked.
Technically anyone with unlocked phone could.
But why would Michael create a message incriminating himself?
Could Emily have typed later?
Metadata showed Monday.
Consistent.
Then the cracked phone.
Glass fragment from kitchen floor was consistent in composition/color with missing corner, but not uniquely matchable.
Fine.
No CSI miracle.
Then cloud photos.
At 7:12, Emily had taken one photograph of her abdomen in bathroom mirror.
Bruise beginning.
No one knew until technician found it among synced images.
That established timing.
Then Michael’s account said he pushed defensively because Emily shoved him first.
Any injury to him?
No.
Could self-defense justify pushing a fifteen-year-old?
Maybe if reasonable force to stop assault.
But he had control of her phone.
The argument started because he took it.
Then smart-home camera?
No full camera in kitchen. Good.
Could neighbor hear?
No.
Then one unexpected witness.
Lily? No sibling. Let's not add.
Maybe Sarah's sister passed by? No.
Keep evidence documentary.
Then Michael’s own notes.
His phone not seized yet? Prosecutors obtained warrant for specific communications after probable cause. His personal device yielded a message to Kevin Monday at 9:26:
Em and I got into it. She went backward into island. Clinic wants ER but she’s fine. If Sarah finds out she’ll go nuclear.
Kevin:
Take her to ER if doctor said.
Michael:
No. She’s calming down.
Kevin:
Mike.
No reply.
There.
Contemporaneous admission:
Clinic wants ER.
He chose no.
Then another message Tuesday morning:
She says pain is worse. I think anxiety.
Kevin:
Tell Sarah.
Michael:
Not yet.
There.
Then Wednesday:
No messages.
Thursday 5:11:
Michael to Kevin:
Sarah wants ER now. I told her not necessary.
Kevin:
You need to stop managing this.
This was no longer:
He misunderstood.
He had been warned by doctor.
Then brother.
Then daughter.
He chose secrecy.
Still:
Did he know there was a bowel perforation?
No.
Did he intend medical harm?
No evidence.
But neglect/endangerment theory strengthened.
Then prosecutor filed charges.
Not attempted murder.
Not aggravated fantasy.
One felony child-endangering count based on knowingly creating/continuing substantial risk and withholding recommended care after the injury.
One assault-related count based on the shove causing serious physical harm.
A lesser misdemeanor assault alternative.
Michael surrendered through counsel.
No SWAT team.
Bond conditions:
No contact with Emily.
No return to house.
No possession of firearms where applicable.
No travel outside state without permission.
Compliance with family court.
He pleaded not guilty.
Then media?
No.
Not famous.
No news cameras.
A private family catastrophe.
Then his employer placed him on unpaid administrative leave pending case.
Employment policy.
Not my doing.
May you like
Then Mark? No.
Need Chapter 10 confirm central secret through maybe Michael's own recorded statement? We already have strong. Chapter 10 can confirm that he knew exactly why pain: not only shove, but he deliberately hid ER referral and phone; perhaps the clinic discharge instructions were found folded in his desk with a handwritten note? Need central secret beyond allegation: he had hidden signed discharge note and told a coworker "I pushed her." We have text to brother. Chapter 10 can frame "What Michael knew." Great.
