Chapter 8 - the hearing prepared before christmas

Walter’s emergency custody petition was formally heard despite his detention.

His attorney argued that Sarah had become hostile, obstructed specialized treatment, and turned Lucy against her father and grandfather.

The request asked the court to transfer Lucy temporarily to North Ridge Pediatric Recovery Center.

Miriam presented the clinic consent forms.

The judge read the clause allowing “retention and commercial analysis of biological material.”

Walter’s attorney called it standard medical language.

Dr. Lena Price testified otherwise.

“No burn center requires commercial control of a child’s tissue to provide treatment.”

Walter appeared by secure video.

He wore a medical collar and spoke softly.

“I only want my granddaughter to receive the best care.”

Sarah looked toward him.

“You put the chemical in her slippers.”

“That allegation remains disputed.”

“Your photographs show you holding the packet.”

“I trusted Caroline’s safety assessment.”

“You asked Lucy whether it was burning.”

“I asked whether the warming feature was working.”

He attempted to convert the same sentence into concern.

Then Lucy requested permission to speak privately with the judge.

Sarah worried the hearing would burden her.

Lucy insisted.

The judge questioned her in chambers with a child advocate present.

Lucy described the Christmas Eve study.

Walter measuring her feet.

Telling her not to remove the slippers.

Asking whether she wanted to help “save the family company.”

“What did you think that meant?” the judge asked.

“That if I was brave, Dad wouldn’t lose his job.”

Mark had not worked for ThermaStep in years.

Walter used Lucy’s fear that the family would collapse financially.

He told her Sarah would become angry if she knew about the surprise.

He made secrecy feel like protection.

The judge denied every custody request and issued a permanent protective order pending criminal proceedings.

Sarah remained sole trustee and guardian.

Mark’s parental contact would occur only under professional supervision after his release, if Lucy wanted it.

The North Ridge clinic was barred from receiving any sample or record belonging to her.

Walter’s control over Lucy’s shares was suspended.

Miriam immediately used the trust vote to block the merger.

North Ridge’s stock fell within hours.

Investors demanded the HX-17 archive.

Federal regulators raided both companies.

The evidence exposed ninety-three child test participants across seven states.

Some families had signed misleading forms.

Others had never known their children were studied.

Sarah refused to let Lucy become the public face of the scandal.

“She is a witness and survivor, not a company symbol.”

The trust hired independent advocates for every affected family.

Lucy’s burns began healing, but nerve testing showed reduced sensation in two toes.

The damage might improve.

No doctor could promise.

Walter’s attorney announced that Lucy had a preexisting nerve disorder and that Sarah’s delay in removing the slippers caused the injury.

The claim came from a medical record created when Lucy was eight.

Dr. Henry Sloan had diagnosed “reduced pain awareness” after a routine examination Walter arranged.

Sarah had never seen the report.

The original pediatrician denied making the diagnosis.

His signature had been copied.

The false record allowed Walter to argue that Lucy failed to react normally and Sarah failed to supervise a known condition.

Another document had been waiting years for the right injury.

Detective Reed found more childhood records in Walter’s archive.

A custody petition draft dated four years before Evelyn died.

Walter had considered taking Lucy long before the trust transfer.

Why?

The earliest draft said:

Child must remain available as primary hereditary responder.

Walter and Caroline believed HX-17 reactions followed a genetic trait inherited through Evelyn’s family.

Lucy was not chosen merely because she owned shares.

She shared Evelyn’s biology.

Sarah asked Dr. Price what that meant.

“It means Evelyn may have reacted differently to the chemical than other adults.”

“Did Walter know?”

“Yes.”

“Before the sauna?”

The research archive contained Evelyn’s genetic profile beside a handwritten note.

Extreme responder. Controlled exposure may produce decisive endpoint.

The note carried Dr. Sloan’s initials.

👉 Evelyn’s fatal sauna exposure had been calibrated using the same inherited sensitivity Walter later exploited in Lucy.
