Chapter 19 - Vivian’s settlement

Vivian and Daniel mediated their commercial dispute.

Their side agreement was enforceable.

Payment timing disputed.

Settlement:

Daniel acknowledges $260,000 obligation, not full $300,000, payable only from first qualifying sponsor distributions or project refinance proceeds.

No immediate personal cash payment.

Vivian releases broader claim.

Why $260,000?

Some cure contributions allocated differently after Ross investment and sale.

Their accountants reconciled.

No theft.

No family bankruptcy.

Then Alder Row.

Leasing climbed to 39%.

MidState covenant cured.

No default.

Project stabilized.

Vivian’s guaranteed exposure reduced over time.

Daniel’s too.

Then Bennett Urban board.

Samuel Ross proposed independent chair.

Vivian objected.

Daniel supported.

Outside investors supported.

Vivian did not own controlling percentage.

Independent chair appointed:

Caroline Webb.

Daniel remained managing partner.

Vivian retained board seat.

No family monarchy.

Then conflicts policy:

No sponsor may represent affiliate capital as available without signed commitment.

No related family side agreements undisclosed to board.

All guaranties disclosed to investors.

Ordinary governance born from embarrassment.

Then divorce decree drafting.

Vivian tried one last intervention.

She emailed Daniel:

Do not sign a decree saying Claire owns Briarcrest outright. That will follow you forever.

Daniel replied:

The LLC owns it. I signed that three years ago.

Vivian:

You built that house too.

Daniel:

And I’m getting a settlement credit. Stop.

There.

Then he blocked her for forty-eight hours.

Not permanent.

Enough.

Then I received another message from him through attorneys.

He wanted to remove the thirty-day occupancy arrangement.

He had rented an apartment.

Could vacate immediately after decree.

Why?

“I don’t want to stay somewhere I used as leverage.”

That was the first choice he made that cost him comfort without anyone forcing it.

I agreed.

Then Northlight mortgage.

Could I afford Briarcrest alone?

Yes.

But carrying cost:

High.

Taxes.

Insurance.

Maintenance.

Would I want it?

Still uncertain.

No need decide before decree.

Then my burn scar.

Dermatologist discharged me.

Faint discoloration.

Likely continue fading.

No further treatment unless cosmetic concern.

I took one photograph.

Not evidence.

For myself.

Then deleted it from favorites.

The police had what they needed.

I did not need to look every morning.
