Chapter 19 - The criminal case

Gloria faced criminal charges related to child endangerment and unlawful restraint.

Not kidnapping.

Not attempted murder.

Not starvation.

The prosecution focused on what could be proved.

A six-year-old intentionally locked in a dark storage room from roughly the evening until after midnight.

No accessible bathroom.

No water.

No meal after refusing dinner.

Guardian left the house.

Prior repeated use of the same locked space.

Gloria’s defense emphasized:

No serious physical injury.

No intent to cause lasting harm.

Behavioral discipline.

Walt’s presence in the house.

That last point helped and hurt.

If another responsible adult was home, Gloria had not technically left Lizzy completely alone.

But Walt did not know or verify her condition.

Eventually, Gloria accepted a plea to a felony-level child-endangerment offense with an unlawful-restraint-related count reduced as part of the agreement.

She admitted:

She intentionally latched the door.

She knew Lizzy could not open it.

She left the house without personally ensuring Lizzy had been released.

She had used the room previously.

She did not admit she wanted to physically injure Lizzy.

Evidence did not support that.

Sentence:

A short custodial term measured in months.

Most of a larger sentence suspended.

Probation.

Mandatory parenting/guardianship education.

No unsupervised contact with Lizzy.

No guardianship role over minors during supervision.

Counseling.

People online wanted ten years.

Some relatives wanted no jail.
