Chapter 15 - My case ends differently

I completed diversion.

Twelve anger-management sessions.

Twenty hours community service.

No contact violations.

No further physical incident.

The prosecutor dismissed my charges as agreed.

No conviction.

Not because what I did became acceptable.

Because diversion existed for qualifying first-time low-level offenders and I completed it.

I did not hide that from family court.

Judge McBride already knew.

Then Judith’s sentencing.

Presentence:

Fifty-eight.

No prior record.

Business owner.

Grandmother.

Victim two years old.

Visible bruise but no lasting physical injury.

Cruel verbal statement.

Prior warning not to physically discipline.

Acceptance late but clear.

Judge imposed:

Thirty days local jail, all but five days suspended.

One year probation.

Parenting/anger intervention.

No contact with Sadie except by future family-court permission.

Restitution for uncovered pediatric costs.

Small.

No grand fortune transfer.

Five days actual custody.

Judith cried.

Noah attended.

I did not.

Rebecca said:

“You don’t need to watch every consequence.”

She was right.

Then CPS final assessment.

Judith:

Substantiated physical-abuse concern.

Noah:

Failure-to-protect concern substantiated based on known prior incident and birthday response, but agency noted substantial subsequent compliance.

Me:

No abuse finding toward Sadie.

My retaliation against adults handled separately; agency recommended continued conflict-skills work.

Case stayed open briefly for monitoring.

Then parenting.

Noah’s unsupervised visits expanded to full Saturdays.

No incident.

Sadie came home saying:

“Daddy pancakes.”

Normal.

Then first overnight request.

I opposed.

Judge asked why.

“Trust.”

“Specific safety concern?”

“He hid Judith’s prior handling.”

“Since order?”

“No.”

“Contact with Judith?”

“No.”

Noah had blocked Judith from his apartment building guest list.

He had not secretly visited her with Sadie.

Then Judge ordered one overnight every other week beginning after a month, with Noah prohibited from third-party care by Judith or any person not disclosed.

I hated it.

Sadie loved it.

The first overnight:

I did not sleep.

The next morning Noah sent only:

She ate breakfast. Pickup 10 as ordered.

No photo unless requested.

No performance.

He returned her on time.

Then I found a pink frosting stain on her sock.

My body reacted.

“Where did this come from?”

Noah blinked.

“Strawberry yogurt.”

I felt ridiculous.

Trauma is not always intelligent.

I apologized.

He said:

“I get it.”

I hated that too.

Then the HEG note repayment arrived.

$170,000 into marital escrow.

Exactly as ordered.

Remaining principal:

$90,000.

Still unresolved.

House.

Custody.

Divorce.
