We did not settle before trial.
Two issues remained too far apart.
Custody.
The $90,000 unrepaid HEG bridge.
House buyout mechanics.
Judge McBride scheduled three days.
First:
Parenting.
Rebecca did not argue Noah should lose Sadie.
That surprised him.
Our position:
Primary residence with me.
Shared legal custody with tie-breaking on medical and therapy initially because Noah had hidden safety information.
Gradually expanded parenting time.
Judith no contact until separate review after probation and child-safety assessment.
Noah asked:
Equal parenting time.
Joint decisions.
No automatic permanent ban on Judith.
Then parenting evaluator Dr. Samuel Reed testified.
Noah’s strengths:
Warm bond.
Consistent visits.
Appropriate care.
Stable home.
Acknowledged failure.
Complied with no-contact.
My strengths:
Primary routine caregiver.
Protective.
Stable.
Accepted accountability for retaliation.
Completed diversion.
Concerns:
My residual hypervigilance.
Noah’s conflict avoidance and history of letting Judith override boundaries.
Then Dr. Reed said:
“Noah’s birthday conduct reflects a serious failure of protection and an inappropriate willingness to view family conflict through litigation strategy.”
Then:
“His behavior over the subsequent six months is materially different.”
That was the sentence I feared.
And needed.
Then me.
Did I believe Noah loved Sadie?
“Yes.”
Did I believe he would hit her?
“No.”
Did I believe he might let Judith regain access too soon?
“Yes.”
Why?
“Because he spent years treating his mother’s approval like oxygen.”
Noah stared.
Then his lawyer:
“Has he violated the no-contact order?”
“No.”
“Asked you to secretly allow Judith?”
“No.”
“Taken Sadie near Judith?”
“Not that I know.”
“Any evidence?”
“No.”
Good.
Then Noah.
He admitted everything.
“Did you plan to use Alyssa’s reaction?”
“Yes.”
“Did you ask Judith to strike Sadie?”
“No.”
“Did you ask her to provoke Alyssa?”
“I told her not to.”
“Did you understand Judith wanted confrontation?”
“Yes.”
“Then why hold the party there?”
Noah’s eyes filled.
“Because I wanted my mother to be right about Alyssa.”
Silence.
“Why?”
“If Alyssa was the unstable one, I didn’t have to admit the marriage was ending because I lied about money.”
There.
That was deeper than finance.
Then:
“Do you still believe Alyssa is unstable?”
“No.”
“Do you believe her hitting you was acceptable?”
“No.”
