Chapter 17 - The custody trial
Mark testified first.
His attorney asked:
“Do you love Emma?”
“Yes.”
“Lily?”
“Yes.”
“Want a son?”
He hesitated.
“I used to.”
“Now?”
“No.”
“Why?”
“Because I finally understood wanting one had become a judgment on the children I already had.”
That was a good answer.
Then cross.
Rebecca:
“When did you understand?”
“After the birthday.”
“After Emma cried?”
“Yes.”
“After Lauren left?”
“Yes.”
“After the trust dispute threatened your committee seat?”
Mark’s jaw tightened.
“That too.”
“Did financial consequences help you understand?”
“Yes.”
Honest.
Then:
“Would you have challenged Diane if Harbor had approved the full $572,000 and you received your Legacy seat?”
Silence.
“I don’t know.”
There.
No convenient redemption.
Then me.
Mark’s lawyer asked:
“You removed the children from the marital home without his agreement?”
“Yes.”
“Did he pose a physical threat?”
“No.”
“Did you ask him to leave instead?”
“No.”
“Why?”
“I needed to remove Emma from the room immediately.”
“Why not return the next day?”
“Because Mark had not apologized and Diane was still coming to the house.”
“Could you have sought a court order first?”
“Not before leaving a birthday party.”
Fair.
Then:
“Have you ever told Emma she can refuse to see her father forever?”
“No.”
“Did you support overnight parenting time when she was upset?”
“Yes.”
That helped.
Then Dr. Park.
Not custody evaluator, limited.
Emma showed:
Hurt.
Anxiety about Diane.
Fear father valued sons more.
No evidence I coached exact statements.
Then custody evaluator.
Mark’s relationship with both girls meaningful.
He had been involved parent.
School pickup.
Soccer.
Dentist.
Homework.
The birthday did not erase ten years.
But his enmeshment with Diane impaired judgment.
My risk:
Overprotecting Emma by validating avoidance too strongly.
Good.
Then Emma did not testify publicly.
Judge interviewed through appropriate procedure? Could consider child views via evaluator. At ten, no need open court.
Emma wanted:
Live mostly with me.
See Dad.
No Grandma right now.
Stay same school.
Lily wanted:
Both parents.
Grandma “only if Emma isn’t sad.”
Children should not manage adults.
Judge reserved final parenting decision.
Then property trial scheduled separately.
Trust court still unresolved.
