Chapter 17 - THE LOAN APPLICATION

The bank called me directly after my attorney sent notice that I had not agreed to guarantee Bennett Family Holdings.
Their counsel was careful.
“Mr. Bennett, we have not funded anything.”
“Good.”
“Your father represented that family capital commitments were substantially complete.”
“Mine was not.”
“Understood.”
“Did he say I already agreed?”
A pause.
“He represented you were expected to participate.”
Not forged.
Not fraud by itself.
Then:
“Did he provide my financial statement?”
“Yes.”
“Authorized?”
“We were told it came through family office.”
I had not authorized that specific disclosure.
But Robert had access to older material because I gave it.
Again.
No hacker.
No miracle.
Old trust used for new purpose.
The lender withdrew the application pending a fresh package without me.
Without my guarantee, deal no longer met leverage requirements.
Robert blamed me.
Technically my refusal killed the deal.

Important distinction.
