Chapter 15 - The copied signature charge

The financial criminal case took longer.

Prosecutors charged Ryan with offenses related to fraudulent use of a signature/document and attempted deception in obtaining credit.

Not a giant securities-fraud conspiracy.

No charge against Melissa.

The lender had not advanced funds based on my collateral.

No actual $1.8 million loss.

That reduced damages.

Still:

Ryan knowingly submitted a document bearing my copied signature.

Represented it as current spousal acknowledgment.

Then sought ratification only after lender challenged it.

His defense:

The document was preliminary.

No perfected pledge.

Lender independently verified.

He believed I had generally consented to household investment support.

Then my prior email:

Up to $100k joint investment.

Not $1.8m separate pledge.

Big gap.

Then POA.

He argued he potentially had authority anyway.

Prosecution:

Then why not submit POA honestly?

Good question.

Then lender.

Summit Crest officer testified:

“If we had believed Lena directly signed and if custodian had confirmed, it would have affected underwriting.”

But custodian did not.

So attempt/incomplete fraud rather than completed loss.

Then plea negotiations.

Ryan refused felony plea initially because career.

His new employer? He had been placed on leave by his own firm? He worked at Carter Commercial Strategies, a small advisory company? Let's simplify: Ryan had served as senior director at Canyon Peak Realty, separate from Cobalt. They placed him on administrative leave after assault and financial allegations, later terminated for undisclosed outside conflicts with policy? Need realistic.

Ryan's employment contract required disclosure of outside sponsor roles. He had disclosed Cobalt partially? He failed to disclose related compensation with Melissa's firm.

Employer investigation found policy breach and terminated him.

Not because brothers.

He later relied on consulting income.

That made felony plea frightening.

Case went toward trial.

Main financial/property conflict still active.

Good.
