Chapter 9 - The video before the birthday
Emma’s tablet video had metadata.
Created:
10:11 a.m.
Birthday morning.
Original file intact.
No editing.
The call with Denise occurred around 10:24.
Then Denise produced her own call log and contemporaneous notes after receiving a subpoena.
Not privileged.
She was not an attorney.
Her note said:
Margaret again asked about documenting emotional dysregulation in granddaughter in context of son’s possible separation. Advised not to stage, provoke, coach, or selectively record. Recommended son seek professional custody advice and parents pursue child assessment if genuine concerns.
Good.
Then another call three weeks earlier.
Margaret asked:
“If a child always melts down with one parent, does that matter in custody?”
Denise:
“It can matter if there is a genuine pattern, but family-court evaluators examine context and both homes.”
Then:
“Could a grandparent provide records?”
“Anyone can provide information if requested, but recording a child to build a case can damage trust.”
Margaret heard only:
Can provide.
Then Jason’s draft parenting notes.
His lawyer produced documents he chose to rely on, while attorney communications remained privileged.
One page Jason himself created:
If separation
keep Emma same school
50/50 if schedules work
Mom can cover after school 2–3 days
Laura likely wants school-week base
consider private school only if both agree
do not fight in front of Emma
Not sinister.
Then later note:
Mom says Laura encourages meltdowns. Need actual professional opinion, not Mom.
That helped him.
He was not fully aligned with Margaret.
Then why was she building a file?
The answer was in her own folder produced during evaluator collateral process and later discovery in grandparent litigation.

Draft caregiver authorization.
I stared at that document.
It was not a custody order.
Not from court.
A standard temporary caregiver authorization form allowing a parent to authorize another adult for:
School pickup.
Routine medical consent.
Activities.
Emergency care.
Duration:
Ninety days.
Margaret had filled in:
Jason Hayes as authorizing parent.
Margaret Hayes as caregiver.
Emma Hayes as child.
Unsigned.
Why?
She said:
“In case Jason needed help after separating.”
Then another page.
Proposed schedule:
Monday–Friday school mornings:
Jason.
Afternoons:
Margaret.
Tuesday/Thursday overnight:
Margaret? Too much. Better no, evenings at Jason.
Weekend with Laura:
Alternate.
This was not something Jason had drafted.
Margaret had.
Then note:
Need Jason to see one full escalation without Laura smoothing it.
There.
One full escalation.
What was the birthday supposed to be?
