Chapter 3 - The first playback

Police arrived around noon.

Detective? No.

At first, patrol.

Officer Kelly Morgan.

Uniform.

Body camera.

Calm voice.

She asked to speak with me away from Ben.

I agreed.

Then I gave her the phone.

“I think there’s an audio recording.”

“Did you intentionally record the conversation?”

“Yes, before the incident. I forgot it was still running.”

Ohio permits recording when one party to the conversation consents.

I was a participant.

Still, Officer Morgan did not give me a legal lecture.

She said:

“We’ll preserve the original appropriately. For now, can you play it without altering the file?”

I nodded.

We did.

Not all forty-three minutes.

First, I scrubbed toward the time.

The recorder displayed waveform peaks.

I found my voice:

“Ellie—!”

Then a sound.

Liquid hitting fabric and floor.

Ellie’s scream.

My footsteps.

The slap.

“What have you done?!”

Linda:

“What the hell is wrong with you?”

Me:

“You threw coffee on her!”

Linda:

“I did not.”

Running water.

Ellie crying.

Then the source dialogue.

“I was just startled and spilled it!”

“She’s only two years old!”

Useful.

But not proof of intent.

Then Officer Morgan said:

“Go back thirty seconds.”

I did.

The kitchen had been quieter.

Television in background.

My knife against cutting board.

Linda’s mug setting against something.

Then Linda’s voice.

Not shouting.

Low.

“Leave it.”

Ellie made a toddler sound.

A little laugh.

Linda again:

“I said leave it.”

Then my:

“Ellie—!”

A chair scraped.

Then coffee.

Officer Morgan looked at me.

“Do you remember Linda speaking to Ellie before she stood?”

“No.”

Probably because I was at the counter.

Then she said:

“Keep listening.”

We did.

After I called 911, I had put the phone down again while continuing to cool Ellie.

The recording captured Ben.

“Mom, what were you thinking?”

Linda:

“She grabbed Caleb’s cup again.”

Ben:

“So?”

Linda:

“I told her twice.”

Ben:

“She’s two.”

Linda:

“So now you remember?”

Silence.

Then Linda, lower:

“Maybe she’ll remember next time.”

Everything in me stopped.

Officer Morgan raised one hand.

“Don’t say anything yet.”

The recording continued.

Ben:

“Mom.”

Linda:

“What? I didn’t mean for it to hit her face.”

There.

Not:

I spilled.

Not:

She bumped me.

“I didn’t mean for it to hit her face.”

Ben:

“You threw it.”

Long silence.

Linda:

“I tossed it away from me because she was grabbing.”

Ben:

“That’s not what happened.”

My breathing changed.

Officer Morgan looked at me.

“You didn’t hear this in the kitchen?”

“No.”

I had been at the sink with Ellie screaming against my shoulder.

The recording had heard what I could not.

Then Linda said:

“You say one word to Megan about this and she’ll never let me see Ellie again.”

Ben did not answer.

Not in that moment.

That silence would become a second case.
