Chapter 21 - THE DIVORCE FILED FROM A HOSPITAL BEDEvan opposed the divorce for eleven days.
His criminal attorney advised him that remaining married might preserve testimonial privileges, financial claims and access to Mara’s medical condition.
He filed a petition alleging Mara lacked capacity because of pain medication, hypothermia and trauma.
The petition relied on a physician’s declaration prepared before her fall.
The same false declaration Claire used to report Mara dead.
Judge Rebecca Hall dismissed it and appointed an independent medical advocate—not Evan—to confirm Mara understood the proceedings.
Mara answered every question.
She knew the date.
Understood the property consequences.
Recognized the difference between divorce and criminal punishment.
Could explain why some marital assets remained frozen.
Forgot one nurse’s name.
That did not make her incapable.
The divorce continued.
Evan claimed the Blackridge properties belonged partly to the marriage because he had managed budgets and renovations. Auditors separated ordinary marital investments from assets connected to Theodore’s trust and Northstar.
The couple’s Denver home was legitimate marital property.
It would be sold.
A vacation account contained stolen disaster funds.
It entered restitution.
Evan’s business investments included lawful income and money diverted through Claire’s shell companies.
Each amount received separate treatment.
Mara did not automatically receive everything because he tried to kill her.
Evan did not retain assets created through fraud because marriage once gave him access.
The seven private cabins remained frozen during the Northstar property review.
Cabin Seven belonged to the Ellison safety trust, not to Evan.
The red cashmere robe remained criminal evidence.
Evan requested hospital visitation.
Denied.
He requested written medical updates because he was still legally Mara’s husband.
Mara revoked the authorization.
The court recognized that marriage did not require an injured spouse to provide health information to the person accused of causing the injury.
The final divorce hearing occurred by secure video four months later.
Mara could sit upright for forty minutes. Her left hand remained partly immobilized. A metal frame supported the leg.
Evan appeared from detention.
He looked toward her brace.
“I never expected the injury to be that severe.”
“You expected me to go over a ridge.”
“I thought the snowmobile would stop lower.”
“You cut the backup brake.”
“Claire drugged you more than we discussed.”
“You still watched me leave.”
Evan’s attorney objected to turning the divorce into criminal testimony.
Mara stopped.
The criminal trial would decide guilt.
The divorce needed only her current choice.
Judge Hall asked whether reconciliation remained possible.
“No,” Mara said.
Evan remained silent until his attorney touched his arm.
“No.”
The decree ended the marriage for cruelty, fraud, abandonment and financial misconduct.
Mara restored no previous surname because Ellison had always been hers.
Simon’s biology did not require Reed.
Theodore’s wrongdoing did not make every year under Ellison false.
Evan received no Northstar access, mountain authority or disaster funds.
He retained his share of legitimate marital property after debts and restitution.
Mara accepted that outcome.
Justice did not require pretending he had never paid a mortgage or contributed lawful income.
After the decree, Evan asked to send one personal letter.
Mara allowed her attorney to preserve it unopened.
She did not promise to read it.
The prosecution obtained Evan’s detention calls.
He told his father:
“You placed me beside her before I knew what she owned.”
His father answered:
“I gave you an opportunity.”
“You made me an asset.”
“You chose what to do with it.”
The father’s statement was self-serving.
It was also accurate.
Northstar created access.
Evan created the marriage’s final betrayal.
Investigators recovered his internet searches from seven months before the blizzard:
Presumed death without body.
Snowmobile brake failure evidence.
Spousal trust transfer after mountain accident.
How long hypothermia takes.
Claire had not typed them.
