Chapter 8 - The police report

Lucía filed a report.

Not Arturo.

Lucía.

Her thigh had bruised after my kick.

No fracture.

No head injury.

She had raised her hand first.

I had caught her wrist.

Then kicked as she pulled forward.

Was I defending myself?

Potentially.

Was the kick proportionate?

Arguable.

I called Dana Reeves, a criminal-defense attorney recommended by Rebecca.

Apparently my year needed more lawyers.

Dana watched three guest videos.

One captured Lucía raising her arm.

Another showed my kick.

No perfect angle.

Dana said:

“You have a stronger self-defense argument than if she had already stepped away.”

“But?”

“You also had just physically attacked your father.”

“Yes.”

“That affects how prosecutors may view overall escalation.”

“I know.”

Arturo did not file a complaint over the cake shove.

He threatened to.

Then didn’t.

Probably because board counsel had told him to stop generating side issues.

Lucía pursued hers for two weeks.

Then prosecutor offered both of us a chance at diversion if the evidence supported mutual low-level assaultive conduct?

Could be messy. Better Lucía declines prosecution after counsel? But once report filed, state decides. Prosecutor reviewed and declined charges against Elena based on ambiguous self-defense? Yet she admitted kick. Let's ground: prosecutor declined assault charge for kick due insufficient evidence disproving self-defense beyond reasonable doubt. Separate cake shove could support misdemeanor, but Arturo refused cooperation? State could still. Guests video. Maybe pretrial diversion on cake incident. Let's do that.

I was cited for misdemeanor assault related to pushing Arturo into the cake.

No arrest.

No handcuffs.

Summons.

Dana negotiated diversion.

Anger-management class.

Community service.

No unlawful contact.

Dismissal after completion.

My kick against Lucía was not separately charged because footage supported that she raised a hand and moved toward me first, making proof beyond reasonable doubt harder.

Was I proud?

No.

Did I think Arturo deserved frosting?

Emotionally, sometimes.

Did I want Noah learning that maternal protection means physical retaliation?

No.

So I told him.

“I got consequences for Grandpa.”

He stared.

“Because cake?”

“Because I grabbed him.”

“But he paid Sofia.”

“Yes.”

“That’s worse.”

“Different.”

May you like

“Adults love that word.”

Correct.
