Chapter 2 - THE HEARING STOPS BEING ABOUT MEMORYJudge Markham recessed the guardianship hearing within three minutes.

Not because she had decided Mom was competent.
Not because the recording automatically proved a crime.
Because what we had just watched changed the factual basis of the proceeding.
The original guardianship petition claimed:
Margaret misplaced medication.
Margaret falsely accused Andrew of hiding pills.
Margaret had paranoid beliefs about Vanessa attacking her.
Margaret confused events surrounding Robert’s death.
Now a recording appeared to show:
Vanessa striking Margaret.
Andrew removing medication.
Robert confronting Vanessa about his water.
And some unresolved statement about Andrew’s identity.
That did not make Mom automatically competent.
A person can be abused and cognitively impaired at the same time.
Judge Markham said exactly that.
“This court will not substitute a dramatic recording for a capacity evaluation.”
Good judge.
Then:
“But I will not allow alleged symptoms that may have been caused or manipulated by the petitioners to serve unexamined as evidence supporting their control over Mrs. Whitmore.”
Better.
The temporary financial powers Andrew had received six weeks earlier were suspended.
Not because he was found guilty.
Because conflict of interest had become obvious.
A neutral professional fiduciary was appointed temporarily for limited high-risk transactions.
Mom retained control over ordinary personal spending.
Her medical decisions remained hers unless physicians found otherwise.
Andrew’s attorney objected.
Judge Markham replied:
“Your client is on video removing prescribed medication while telling the proposed ward that she already took it. I am not leaving him in charge of medication management this afternoon.”
No one had a good response to that.
Then she ordered the original timer, memory card, tablet copy, and forensic image preserved for law enforcement.
Vanessa whispered:
“This is insane.”
Mom finally spoke.
Not to the judge.
To Vanessa.
“No.”
Her voice was low.
“This is what I remembered.”
That sentence changed the room more than the video had.
