Chapter 13 - The lender file

The lender’s internal records were boring.
Boring saved us.
Application timestamps.
Email headers.
Uploaded PDFs.
Broker notes.
One note read:
Spouse Daniel Hale traveling; wife Rachel Hale coordinating co-owner consents.
Wife coordinating.
Not owner.
The broker assumed authority.
Another note:
Rebecca Hale expected to sign at family meeting Saturday.
I stared at that.
Family meeting.
My nephew’s birthday.
Who told the broker that?
Email from Rachel.
Daniel’s purported signature had been uploaded two days earlier.
Metadata did not prove who placed the signature digitally.
But the source file came from Rachel’s laptop.
Her attorney eventually argued she believed Daniel’s prior authorization covered preliminary documents.
Then investigators found a text.
Rachel to Dad:
Daniel still doesn’t want to sign anything final until Rebecca agrees. I can handle his prelim piece.
Dad:
Do what you need to get us to the table.
There.
Not:
Forge him.
Not:
Fake his consent.
Ambiguous.
But Rachel knew Daniel had not agreed to final borrowing.
